These draft terms govern your use of the The Marketorium website and application. By creating an account or using the service, you agree to them.
The service
The Marketorium provides AI-assisted creation, organization, evaluation and export of marketing content for your business. We may add, change or remove features as the product evolves.
Accounts
You are responsible for your account, your password, and the activity that happens under it. You must provide accurate registration information and be at least 18 years old, or have your legal guardian's consent.
Subscriptions, billing and credits
Paid plans are billed in advance through our payment provider, Stripe. Subscription prices and included allowances are shown at checkout and in the application. Credits included with your plan refresh each billing period; purchased credit bundles are one-time purchases that do not expire. Credits are charged only for successful generations. You can upgrade, downgrade or cancel at any time; cancellations take effect at the end of the current billing period.
Acceptable use
You may use the service only for lawful marketing purposes and in line with our Acceptable Use Policy. Do not use the service to create illegal, deceptive, harassing or infringing content, to spam, or to attempt to disrupt or gain unauthorized access to the service.
Your content
You keep ownership of the content you create and the brand information you provide. You grant us a limited license to store, process and display it solely to operate the service for you. You are responsible for ensuring you have the rights to the material you upload or import.
AI-generated content
AI generation is probabilistic: outputs may contain inaccuracies, and brand-consistency features reduce but cannot eliminate off-brand content. Review content before publishing or relying on it. Generated imagery may not reproduce exact logo placement or typography.
Termination
You may stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these terms or the Acceptable Use Policy, or that create risk for other customers or the platform.
Disclaimers and liability
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our total liability relating to the service is limited to the amounts you paid us in the twelve months before the claim.
Changes
We may update these terms from time to time. Continued use of the service after a change takes effect means you accept the updated terms.

Beta and provisional features
Some features ship in preview with allowances marked as provisional. Preview features may change, be re-priced or be withdrawn as testing completes. We will communicate material changes to affected accounts before they take effect.
Payment disputes and refunds
Billing runs through our payment provider, Stripe. If you believe a charge is wrong, contact us first; we resolve genuine billing errors quickly, including refunding incorrect charges. Because plans are month-to-month and cancellable at any time, we do not issue refunds for partial months after a cancellation, but your plan remains active until the period ends.
Service availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and third-party outages happen. We will communicate significant downtime, and we do not offer service-level credits to accounts on standard plans, though we always make things right when a platform error damages your work.
Feedback and suggestions
If you send us ideas, we're grateful, and you agree we may use them to improve the service without obligation or compensation. Feedback is voluntary; nothing in these terms requires you to give it, and nothing you send us becomes confidential unless we agree otherwise in writing.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be handled in the courts of competent jurisdiction in Delaware, unless applicable consumer law gives you the right to resolve disputes locally.
Entire agreement
These terms, the Acceptable Use Policy and the Privacy Policy form the entire agreement between you and The Marketorium regarding the service. If any provision is found unenforceable, the rest remains in force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
